Weak legal protection, the final analysis is that the guidelines due to lack of spirit of the Constitution,the right to education of the urgent need for constitutional protection of basic constitutional rights. The protect of Constitution is the necessary requirement to preserve the equal right to education of rural children. It is also the objective need to achieve the comprehensive development and strengthen national obligations and needs. It is also need for the establishment in China of the constitutional review of judicial system, of course,this can not happen overnight.
