The Characteristics, Reasons, Countermeasures Of Criminal Offense Against The Left-behind Children In Rural Areas Of Kaixian

In recent years, left-behind children in rural areas gradually aroused concerns of the community. However, many scholars mainly focus on the crime committed by left-behind children, but leave a blank on the problem of criminal offense against the left-behind children in rural area. Based on the research of the cases related to the offense against left-behind children executed by Kaixian Procuratorate in recent years, this paper analyzes the reasons and characteristics of crimes against left-behind children, proposes corresponding countermeasures, in order to reduce and remove the occurrence of crimes against the left-behind children and help them grow up healthily.This paper consists three parts: introduction, text and conclusion. At the first part, the author sums up the basic circumstance of criminal cases against left-behind children in rural areas handled by Kaixian County Procuratorate from 2005 to 2010. Then he starts from the cases of rape, robbery, intentional injury to analyze the characteristics of the criminal offense against left-behind children in rural areas of Kaixian. The rape offense against left-behind children in rural areas of Kaixian is characterized by characteristics of the suspects and the place the offense occurred. First, the suspects turn out to be older people with low educational level, mostly widowed elderly people. And the suspects and the victim are mostly acquaintances. Second, the crime usually occurs in remote mountainous rural areas. The robbery is characterized by the small age of the suspects, mostly gang crime and the small amount of property. Intentional injury is characterized by the facts that educational methods are improper and it is mainly caused by the dispute among students.The second part analyzes the reasons of criminal offense against the left-behind children in rural areas of Kaixian. There are several factors listed as followings: the lack of security of geographical conditions in rural areas, the lack of awareness of prevention and competence of children, the lack of family education resulting from the fact that parents just focus on the substantial needs rather than emotional ones of their children, the negligence of school management, the high rate of repeating delinquency of juveniles.The third part puts forward the corresponding countermeasures according to the reasons of criminal offense against the left-behind children in rural areas. The realistic significance is laid on this part. It proposes eleven countermeasures: to strengthen family education, to reshape the regulatory role of school education, to emphasize on teacher's morality education, to guide rural labor to flow orderly and reasonably, to establish protection agencies of left-behind children in rural areas, to strengthen the judicial protection of left-behind children, to strengthen the construction of boarding primary schools, to enhance the left-behind children's self-awareness and capacity, to prevent and reduce juvenile delinquency, to create a good social environment, to establish assistance system for left-behind children. In the conclusion, the author raises the prospect of the healthy growth of left-behind children according to China's current conditions.
