A Study On The Issue Of Rural Left-behind Children

Since the reform and opening up,especially the socialist market economic system,China's rapid economic development.This has greatly improved people's living standards,but also produced some problems.With the acceleration of the process of urbanization,the city's job opportunities and wages far exceed the rural areas,so many people in the countryside,especially young adults,are willing to go to the city to find work.But due to the limited knowledge,they can work is often very busy,and because the two economic structure of urban and rural areas,so that they will have to stay in the rural children by their parents or friends or even their own care,therefore,the left-behind children in this group.These left-behind children because of the shortcomings of the current law,legal guardian and the guardian of the rights,obligations and responsibilities of the monitoring system is not perfect,the lack of effective supervision mechanism,produced a series of problems,such as personal safety,education,psychological problems.In order to solve these problems,this paper tries to analyze and research the status quo of the left behind children in rural areas and the existing problems in the system.This paper is divided into three parts: the first part introduces the concept of "children left in rural areas" the definition,characteristics,types and monitoring of the situation;The second part introduces the legal problems existing,custody of children left behind in rural areas include: the legal guardian responsibility is too loose,commissioned guardianship system is not perfect,the specified monitoring does not adapt to the actual situation,lack of responsibility,the provisions of the temporary guardian will not work,lack of " guardian is not qualified" provisions,rural left-behind children guardianship system is not perfect,the lack of supervision mechanism.The third part: put forward countermeasures,custody of the children left behind in rural areas include: improving the monitoring system of rural children left behind,such as to make clear the guardian's qualification,ability and responsibility;improve the guardianship system of children left in rural areas,such as strengthening the government responsibility,clear supervision responsibility of parents;the establishment of monitoring mechanisms of rural left behind children.
