The Research On The Law Regulation Of PPM Criterion In The International Trade

In the contemporary international trade, the trade and environmental issues which is proposed by the developed countries has been formally incorporated into the WTO trade rules and domestic legislation of each country. The debates upon the PPM issue have never stopped since the term came into WTO after the"Tuna Case"between the United States and Mexieo. In the recent years, some developed countries utilize their higher PPM criterion to refuse the products which producted by the developing countries. As the largest developed country in the world, how to improve our legal system of the PPM criterion and protect the interests of China's foreign trade has become an important task.This paper consists of three parts:the introduction, body and the conclusion. The introduction is part of the first chapter,which largely introduces the background and the significance of research and the domestic and foreign scholars on PPM criterion in international trade research. On the other hand, this article also reflectes the innovation. the body is a major part of the article,Ⅱ,Ⅲ,Ⅳ,Ⅴ,Ⅵ.The second chapter is an overview of the PPM criterion, which introduces the background, the definition and the classification of the PPM criterion. This chapter also analyzes the positive impact and the negative impact on our foreign trade.The double-sided impact make the study of this paper more meaningful.ChapterⅢintroduces the present situation and the existing problems of the PPM criterion. This chapter sums the main problems.ChapterⅣintroduces the rules of the PPM criterion of the foreign country and comes to have a revelation of our conclusions through the comparison among the WTO rules,the MEAs rules and the rules of domestic law.ChapterⅤintroduce the improve the legal measures of our legal system PPM,including the theories and the specific measures. This chapter also introduces both the legal response of the PPM criterion and the defense respond which is used to resist the the Trade barriers formed by the PPM criterion.In summary,this article that goes at the basis existed has as much as possible analyzed our legal system of the PPM criterion systematicly through research.it also can combin with the advanced experience of foreign countries and contribute our energy in order to improve the legal system of the PPM criterion to protect the free development of our international trade.
