The Research Of Maritime Administrative Law Enforcement System Of China

China has rich marine resources and accelerates the pace of development and (?)ion of marine resources and the maritime economy develops rapidly in recent years. Meanwhile, ocean politics economic conflicts occur frequently between neighboring countries and us, which bring new opportunities and challenges to the maritime law enforcement. Traditional decentralized administrative law enforcement system is gradually exposed to a number of drawbacks----bloated, fragmented and mclear algorithm, and so on. It is no longer to meet the needs of future development. in the context of building the national service-oriented government, implementing the eform, improving the level of public administration, we are urgent to reform the administrative law enforcement system and unified ocean administrative enforcement powers to achieve the comprehensive development and management of the oceans.This article is divided into five parts described:The first part is the introduction, firstly describes the research background, the significance and the research status of this article seeking to clarify the reasons of the proposed topics, and finally briefly elaborate on the ideas, methods of this study and the main innovation.The second part, firstly defines the meaning of the concepts involved such as administrative law enforcement, institutional, marine administrative system; Then, describes the theory of government failure theory, the reform of Big department system and the related theory in detail aiming for providing a theoretical basis for the maritime administrative law enforcement system and reform measures below. The third part analyzes the history of Chinese offshore administrative law enforcement system; then discusses the key issues arising from Chinese maritime administrative law enforcement system in detail; finally, analyses on the main reasons for the existing problems caused by Chinese offshore administrative law enforcement system in-depth. The fourth section describes the three modes of foreign maritime administrative law enforcement management system, and analyses the administrative law enforcement system of Japan, the United States and South Korea, and concludes the enlightenment to our government attempting to provide experience for Chinese maritime administrative law enforcement system reform. The fifth part describes the (?)rmeasures of Chinese maritime reform of the administrative law enforcement system, introducing the objectives, principles, ideas and the main way of the reform, attempting to provide a reference for decision and practice. The sixth part mainly sorts the research conclusions of this article and summary the entire article.
