The Research Of Modern Universities Governance Structure From The Perspective Of Higher Education Act

Information and technology revolution accelerate the process of popularization of higher education. Rapid economic development in the global context of the times, higher education is becoming more competitive between countries.Compared with the traditional university, the modern university faces unprecedented challenges. Modern universities should fully reflect the value of various stakeholders. They also try to meet the related needs for government, society, market, university administrators and student groups.However, universities in China have long been on the part of the executive-led in the governance structure. The essential features of modern universities governance structure are not yet implemented. These features include the professors'academic management, the separation of administrative and academic, the school-running by law. In the external governance structure, the state administrative centralization of power and the university autonomy are uneven; Universities are attached to the government; Community is unwilling to participate in universities'affairs; Universities lack the necessary self-awareness and practical autonomy. In the internal governance structure, powers and responsibilities of the secretary and the president are unclear; Academic power and administrative power are imbalances.The most fundamental purpose of this paper is that constructing and perfecting modern universities governance structure to balance the various social forces, reflect the interests of all stakeholders and give full play to the university's role in society. Basing on existing research results and selecting the unique perspective of the Higher Education Act, this paper analyzes the modern university governance structure. Its purpose is to expand the new vision on the study of modern universities governance structure, and explore the new ideas on the construction of modern universities governance structure.This paper identifies some of the concepts, such as "modern", "university", "modern university", and "university governance structure". It explores the theories of modern universities governance structure, such as "stakeholder theory", "legal theory", "principal-agent theory" and so on. This paper analyzes the governance structure of the modern universities'history and characteristics. It explores the formation of the main problems and their causes. It presents some recommendations on the modern universities governance structure in China from the perspective of the Higher Education Act. In the external governance structure, it presents some advocates such as construction of limited liability and service-oriented government, construction of university autonomy and self-limited, construction of Higher Education Accreditation. In the internal governance structure, it also presents some advocates such as building the responsibilities of modern universities internal mechanism of checks and balances, coordination of the relationship between administrative power and academic power, and school participation in the implementation mode of governance structure.
