Since China implemented the policy of reform and opening-up, our country's economic growth has been stable and high-speed under the economic globalization environment. Nowadays, China's GDP has caught up with Japan and became the second largest economy. With the arrival of Lewis turning point and China's increased labor costs, our industrial and trade structure need transformation and upgrading. In the future, enterprises have to transform to knowledge and technology-intensive direction. High-tech industry, located at the end of U-curve, which should produce and export high value-added products, instead, processing-trade of computer and e-communication products accounted a large proportion of total trade volume. Therefore, high-tech industry fails to achieve the target of pushing industrial and trade structure upgrading.By calculating Trade specialization coefficient and analyzing characteristic of "337 investigation" cases in one year, I concluded that intellectual property barriers, which come from large multinational corporations in the developed countries, limited upgrading of trade structure in China's high-tech products export field and caused a vicious circle of China's enterprises OEM in the short term. However, intellectual property barrier is a double-edged sword. In the long term, it could promote development of China's high-tech enterprises. For example, it can stimulate them to increase R&D investment,improve management and make them better enter into international markets etc.This paper argues that our high-tech enterprises should take measures to prevent,deal with and summarize afterwards to avoid intellectual property barriers. China's government should also do its best to take advantage of its money,talents etc. By overall planning, strengthening legislative and standards building, the government could help enterprises achieve objectives of independent innovation thus avoiding intellectual property barriers.
