Land is the most basic elements for agricultural production and to protect the lives of farmers. In all the state-owned and collectively owned country, it is important for farmers' interests and rural community harmony and stability that how to relax the restrictions on land transfer and enliven the land market under the legal framework. Chinese rural areas land operation circulation developed based on the institutional innovation. With the progress of society, more migrants from China's rural surplus labor set a basic foundation for land transfer. In the 21st century, China's land transfer market is initially formed. The formation manner and speed lag behind the economic demands of the most rural areas. Besides, the regional differences are very obvious, especially agricultural land is difficult in China's vast western regions. It has the common difficulties and their own specific limitations. Therefore, Considering Xixiang county, Shaanxi Province's history and development status, based on the principles of specific issues analysis, this paper will explore a Xixiang County land operation road under the transfer of agricultural land in the country overall research framework.Based on the domestic and international literature review, the study illustrates the principles of agricultural land, conditions, characteristics and flow patterns. And then the paper analyzes the status, problems and their impact factors of Xixiang County agricultural land. Studying the successful experience of domestic and international agricultural land, this chapter proposed many measures of agricultural land to adapt new situation development: to strength the agricultural land laws and establish dispute resolution mechanisms, to develop agricultural land market and carry on policies to encourage circulation according to local conditions and secure transfer, to hold agricultural land red line, to strength the social security system and to improve agriculture's comparative efficiency. The contents and research frameworks are as follows:Chapter I : Introduction. The main topics are the background, purpose and significance of research.. It summarized the representative theories and ideas, and put forward the main research paper ideas, and methods innovations.Chapter II : Theory analysis on land operation circulation . By summing up the issue of domestic scholars on land transfer, author compared the China's land system, the content agricultural land contract management rights and the definition, methods and patterns of land transfer.Chapter III: The status quo and problem analysis on land operation circulation in Xixiang country.Chapter IV: Determinants analysis. This part analyzed the limited factors from three angles. They are as follows: personal and family characteristics, the environmental factors without any transfer of agricultural land of farmers and farmers whose agricultural land has occurred.Chapter V: Domestic and international comparative analysis of rural land. This part introduced agricultural land practices and the development process in the United States, Japan, Britain, France, Taiwan and mainland China's chronologically, in order to improve China's development of agricultural land transfer practice.Chapter VI: Policy suggestions. Based on the countries and regions' practices, this chapter puts forward policy proposals of agricultural land transfer.The innovations of the article:Firstly, theory with practice. Based on the first-hand information and combined with China's current agricultural land of the theories, this article references and learns the successful experiences from the various countries and regions. It points out the direction of China's agricultural land reform, and makes a very feasible countermeasures and suggestions.Secondly, it integrates economics and legal theory. In factor analysis and countermeasures chapters, the author analyses the importance of agricultural land disputes from the percept of the economics and sociology. Put forward many principles which should be adhering in the trial or mediation of rural land contract management rights. In addition, this paper expresses how to establish fair and reasonable adjustment mechanism.
