Research On Legal Issues Of Rural Forest Resource Management And Protection

Forestry resources are important production for human survival anddevelopment. With China’s economic development and population increase,forestry resources issues have become increasingly prominent. At present, theoverall ecological environment in China is deteriorating. Deforestation, soilerosion and desertification become more severe. Biodiversity has beenseverely damaged, and forest resources, especially timbers, are quite scarce.These issues are particularly prominent in rural areas, resulting fromdeforestation of the forest which has a variety of functions-waterconservation, erosion control, air purification and so on. Therefore, to dealwith environmental problems in rural areas, we must avoid the decline offorestry resources, the key to which is improving the legislation of rural forestresource management and protection. As the rural environmental problemsbecoming increasingly prominent in recent years, the government is also veryconcerned about it and pays much attention to it. In2012, the central fileNo.01pointed out that “Deepen the reform of collective forest right system,stabilize the woodland household contractual relations, basically complete thetask of clarifying property rights and contracting to households in2012, andperfect relevant supporting policies, make sure that the reform of state-ownedforest is well done”. Increasingly severe rural environmental problems havedone great harm to the rural economic development. In the21stCentury,China is faced with urgent and arduous task of preventing the pollution,destruction, waste and other forms of inappropriate development of the forestresources, and protecting and improving forest ecological environment. Inorder to regulate the development and utilization of the forest resources, wemust build a scientific and rational legal system for forest resourcemanagement and protection. But the existing rural forest resourcemanagement legal system is still very lacking, cannot meet the rural economic development and ecological forestry construction, need to be perfect urgently.In this paper, we first do a survey of the forest resource management andprotection in Tongshan County. Then some flaws of the existing legal systemfor rural forest resource management and protection are found through carefulanalysis of the current status of forest resource management and protection inrural areas. Finally, based on the comparison with existing rural forestresource management and protection legal systems in developed countries, weput forward some suggestions that can improve our legal system for ruralforest resources management and protection.
