The Function Of Community Correction On The Prevention Of Juvenile Delinquency

Nowadays, juvenile delinquency, drag-related criminals and environmentalpollution which had endangered the world are called three major malignant tumors.Since the late1970s, early1980s, the overall situation of Juvenile Delinquency isparticularly prominent, which has become a serious social problem, our governmentand the general practitioners are very concerned of it. In1980s, the crime rate of theminors for a further new high, accounting for66%of the total criminal cases at thesame time. The type of crime is becoming more and more diverse，criminal meansand manners are become more and more modern and technology，repeat offenders ofjuvenile delinquency is increasing year by year. Therefore, how to seek a correct andeffective way to rectify the problem of Juvenile Delinquency has become a pressingproblem before us that must be resolved. Through the analysis of CommunityCorrection system in order to find its function which in Juvenile Delinquencyprevention and combine the concrete application of Community Corrections with theprevention of Juvenile Delinquency in our country, I will raised targeted correctivemeasures for Juvenile Delinquency preventive work.This article is divided into three parts: The first part briefly described theCommunity Correction system, including the concept of Community Correction,characteristics, and Community Correction function. The function of CommunityCorrection can be broadly summarized as punishment, help and recovery. The secondpart discussed of the Community Correction system functions to prevent juveniledelinquency. Through analyze the defects in the prevention of juvenile delinquency inorder to explore the unique superiority of Community Correction in JuvenileDelinquency prevention, such as not emphasis on the family in the prevent juveniledelinquency, not pay full attention to the community and other non-governmentalforces in the prevention of juvenile delinquency. On the one hand, it not only effectively avoids “cross-infection” of minors and adults, but also avoids the negativeeffects of "label" to bring to minors, also it adapts to the characteristics of minors, atthe same time, Community Correction can further strengthen the relationship betweenthe community and minors, and the principal is more diversified. The third partanalysis the present situation of community correction in our country, the practicalproblems faced in practice and how to improve the system in our country to betterprevent the juvenile delinquency. According to Supreme People’s Court, SupremePeople’s Procuratorate, the Ministry of Public Security and the Ministry of Justicejointly issued “corrective measures for Community Correction” in2012, we caneasily find that legislators and judicial staff have been fully aware of the features ofCommunity Correction on the prevention of Juvenile Delinquency, and initiallyestablished the policy: reform, saving and education, it puts forward that the adultsand minors should be performed separately, while the initial established correctiveprojects: ideological, legal, and moral education of corrections which are suitable forminors. However, I found the community correction judicial practice in our country isfacing many practical problems, in the prevention of juvenile crime, the core is thelack of specificity, such as the lack of specialized management mechanism, the lackof professional staff, and Community Corrections poorly targeted situation. Therefore,the author put forward a series of localized community corrective measures accordingto the practice and the understanding of this system, such as building suitablemanagement system for minors characteristics especially to take the juvenile courtjudicial officers as an important role in the correction and prevention of juveniledelinquency, to establish a set of specific systems, such as “parents’ school”,"fightfor survival project". It not only can make crime prevention of minors more focused,but also make a more comprehensive protection for minors, in particular, to activelybuilding the community which becomes an important part of Juvenile Delinquencypreventive work through stepping up publicity and give full attention to the role ofneighborhood committees, district offices, and other grassroots organizations in theprevention of juvenile delinquency. It can not only help the criminal redevelopconductively, but also help the minors who have not constitute a crime or just havecriminal tendency to prevent the crime. We should mobilize all social forces to make a positive contribution to the prevention of Juvenile Delinquency.
