Research On The System Of Government Information Publicity In China

Our country is in the critical stage of a profound system transformation, structureadjustment, profound social changes and highlight of people’s internal contradictionnow, whether the government information open and transparent to people, not onlydirectly related to people’s trust in the government, but also to the social politicaleconomic stability. Through the way of legislation to ensure the government dignityand to meet the citizens’ rights of government operation, helping to promote thegovernment running more rational, more transparent, and more responsible, and canprovide more possibilities for the public supervision rights.“The decree of governmentinformation openness” was implemented in May1,2008in our country. The system ofdisclosure of government information in the western countries has already been mature,but our country is in the initial stage of related legislation. In the process of thegovernment information disclosure legislation and the establishment of acomprehensive system of government information disclosure system in the future, weshould draw lessons from system architecture and regulatory aspects in other countries.This thesis is to find out problems, analyze problems, and solve the problems from thefollowing aspects: the first part: introduction. This part introduces the background ofthe legislation of China’s government information; it is the overall description to thewhole thesis. The second part: the basic theory of government information disclosure. Itmainly includes the basic concepts, theoretical basis and the significance of theopenness of government information. The third part: the foreign governmentinformation disclosure and its experience and lessons. The author analyzes thedevelopment processes of the government information disclosure, and summarizes thevaluable experiences from the two laws of the four typical countries. The fourth part:the present situation and the existing problems of our government information publiclegislation. This part analyzes the present situation of the government informationdisclosure of China’s legislation, it points out the main problems: Legal inefficiency, the unclear of openness scope definition, the lack of supervision and relief systemfunction. The fifth part: it puts forward specific recommendations on the disclosure ofgovernment information in China: speed up the government information disclosurelegislation process; pay attention to the coordination with other legal relationship andavoid conflict; clear the scope of disclosure of government information; perfectsupervision and relief system of disclosure of government information and avoid toflow at the form, so as to promote the legislation of disclosure of governmentinformation in China.
