Research On Legal System Of The New Generation Of Migrant Workers’ Right Protection

Since, the party and country attaches great importance to the problems of rural migrantworkers. They issued a series of related policy laws and regulations to safeguard the legalrights of migrant workers. But in real life, the phenomenon of infringing upon the legalrights of migrant workers is ongoing. Studying the rights protection of migrant workers hasbecome a realistic problem of scholars have been discussed.Along with the development of the urbanization process, the migrant-workers has alsobeen the intergenerational exchange, the new generation after80s and90s migrant workershave become the main body in the peasant-workers strength. Therefore, the research of thenew generation of migrant workers’ protection has a very important significance to resolvethe problem of peasant-workers’ right guarantee.Based on the basic principle of Marxism as the instruction, the paper further researcheson improving the legal system of the new generation of migrant workers ’rights protection.This paper mainly divided into four parts, the first part mainly introduce the new generationof migrant workers’ definition and characteristics, the meaning of the new generation ofmigrant workers’ rights and the content of the new generation of migrant workers’ rightsprotection. The second part mainly expounds the theoretical basis of the new generation ofmigrant workers’ rights protection, including the new generation of migrant workers are theimportant part of Chinese working class, Marxist proletarian position, marxist humanisticthought and Marxist theories of human rights. The third part mainly iscusses the flaw of thenew generation of migrant workers rights guarantee system,focusing on the analysis of thenew generation of migrant workers are weak in rights consciousness and conception ofrule,labor rights are not effectively protected, social security right is insufficient, politicalparticipation right is limited, culture education right needs to be full and so on.The forth part is the perfection of the new generation of migrant workers.It includesnine aspects of opinions and suggestions to reform the household registration system and tostrip the registered permanent residence of additional functions, to perfect labor law and toprotect the new generation of peasant workers’ labor rights,to construct social insurancesystem that covers the new generation of migrant workers, to modify the electoral law and toguarantee the new generation of migrant workers’ political rights,to strengthen laborinspection and law enforcement, to construct the new generation of migrant works’ right toeducation security mechanism, to reform the labor arbitration system and to republicanism thearbitration or trial system, and to improve the legal aid system of protecting the newgeneration of migrant worker.
