Research On The Rule Of Law About China’s Civil Servant Accountability System

Civil servant accountability system is an important part of the rule of law in China, its appearance, development and improvement has positive significance for promoting China’s rule of law process and motivating civil servants to perform their duties. With the development of China’s civil service system and the advance of the construction on the rule of law, there are many civil servants removed from office or disciplined for dereliction of duty and other acts, no matter he works in central or local state organs,"Governance YONG" activities also vigorously carried out all over the country. However, due to the large and complex civil service system, concentrated administrative privileges and other facts, there are still many problems in China’s civil servants accountability system’s theory research and practice. Therefore, the study of civil servants accountability system will be beneficial to explore and construct the theoretical system for civil servants accountability system, to promote the construction of the rule of law, to strengthen a whole construction of the civil service and civil servants’legitimate rights and interests, these are significance of the article. The article obtain certain data and information by reading professional books and using network resources, through comparison, analysis and verification to integrate information, form the theoretical framework, and reach the conclusion. The article start with the analysis of the concept of civil servants accountability system, then introduce the theoretical basis of it, and point out the principles, which contain the rule of law, legitimate procedure and powers and powers and responsibilities consistent that it should follow, to provide the basic criteria and guidelines for the standardization, system and the rule of law of civil servants accountability system. These principles are also reference to specific cases at the time of the lack of related legal norms. The article clearly and specifically points out the problems of China’s civil servants accountability system, mainly analyzes them from three aspects that legal basis is imperfect, the accountability mechanism is unsound and accountability elements exist defects. In view of these problems, the research separately explores the paths to the rule of law that can lead the civil servants accountability out of the woods which are the rule of law on constructing a complete and unified accountability legal basis for civil servants, improving the mechanism for accountability of civil servants and optimizing the accountability elements, including sounding multiple accountability subject, standardizing accountability procedures etc. The article also refers to and learns from the West some system and research about civil servants accountability, to reference the outstanding achievements on accountability of civil servants abroad that can be applied to our country.
