Traditional Chinese Medicine Export Of Technical Barriers To Trade In China Law Studies

As the essence of traditional Chinese culture, the traditional Chinese medicine (TCM) has made indelible role in the protection of ancient Chinese prosperity and cultural exchange. But in the modern times, as Chinese unique and traditional medicine, it has encountered tremendous obstacles, resulting in fewer exports and a relatively lower international market share because of the frequently foreign market trade barriers in export markets abroad.This paper is divided into four chapters to explain the Technical Barriers to Trade(TBT) rules of World Trade Organization, the technical barriers to trade traditional which Chinese medicine has encountered in exporting and the countermeasures to TBT from the angle of law. The first chapter elaborated the technical barriers that our country encountered when exporting traditional Chinese medicine, including the main form of technical barriers to trade in the export of traditional Chinese medicine and the impact which TBT caused on the export of traditional Chinese medicine, the second chapter introduced the regulatory system of China and the main market of TCM. In view of the EU market and American market have huge market capacity and strict management system on plant medicine, this paper focuses on the analysis of the EU’s" traditional botanical drug registration program instruction" and the listing application of plant drug in the United States of America, the third chapter of this paper analyzes the causes and influence of TBT on TCM exporting, and the existing problems of the traditional Chinese medicine industry.the last chapter analyzes the strategy of dealing with TBT on the TCM exporting, and I try to give my suggestions mainly from the angle of law...
