On China’s Legal Countermeasures Against Terrorism

Research on anti-terrorism is a hot issue in Chinese academia during theset years. Based on a varous study background, the academia has gained plentiful fruits, while there still remains many theoretical blanks. This article based on the frontier academic achievements and had made the preliminary thinking and discussion in allusion to "anti-terrorism legal countermeasures" such an academic focus. In order to enrich our country anti-terrorism law theory research and adapt to our country to carry out the practical needs of the anti-terrorism struggle, safeguarding national security. Hope to make a little success in public order services.The basic train of thought of this article clarificates the basis understanding of terrorism. At the same time, this paper expounds the main western countries’anti-terrorism legal experience and analysis the present situation of Chinese counterterrorism legislation. Then it puts forward to propose perfect China’s anti-terrorism legal barrier ideas and countermeasures.This thesis consists of four chapters.Chapter one:the summary of terrorism. It gives us an essential explain about how to correctly understand of terrorism and needs to hold a few key points, including the definition,features,the social origin of terrorism, political background, the development tendency of contemporary terrorism, etc. It provides a logic support for anti-terrorism legal countermeasures through this several levels of combing and analysis.Chapter two:"the anti-terrorism legal experience in major western countries". It lists four western countries including the United States, Russia, Britain and Germany and gives the legislation experience of these countries how to answer the counterterrorism activity. This makes reference and bedding for the third part of the paper.Chapter three:"The improvement of Chinese anti-terrorism law system". It pointes out the necessity of the improvement of Chinese anti-terrorism law system. At the same time it lists the anti-terrorism legislation which exists in different departments and makes detailed analysis about improving China’s counterterrorism legislation.The conclusion part points out it is not enough that counterterrorism activity only relies on legal countermeasures. The basic way lies in social comprehensive treatment in all directions forming the basis of terrorism ethnic, religion, culture, education and so on. We need to establish and improve a set of effective social policy coordination mechanism. It is the way to solve terrorism problem at its roots.
