Rural Migrant Personnel Trailing Their Children's Compulsory Education Rights Problem Research

The problem of compulsory education for the children of migrant workers， along withChina’s reform and opening up and the urbanization process， appears and is increasinglyprominent. This topic is related to education， legal， social and other fields， which is also atest of the government’s public management capabilities directly related to social equity and toenhance the overall quality of the citizens.In order to guarantee the quality of education and the fairness of the realization on therights to compulsory education for the children of migrant workers， this paper takes TianqiaoDistrict of Jinan City as a typical case， analyzes the concept of the rights to compulsoryeducation for the children of migrant workers and its connotation， extension， features andsome of the basic theoretical issues from the legal points of view， focuses on the status quo ofthe protection of the rights to compulsory education for the children of migrant workers，analyzes the causes of the deficiency to the rights to compulsory education for the children ofmigrant workers， and to put forward feasible countermeasures to improve the protection of therights.This paper is made up of four parts:Part one: the summary of the rights to compulsory education for the children of migrantworkers. Based on the description of the connotation and denotation of the rights to educationand compulsory education， the paper puts forward the basic elements of the rights tocompulsory education for the children of migrant workers， with special emphasis on theparticularities of the protection of the rights， which include discrimination， special protectionand vulnerable compensation.Part two: the status quo of the protection of the rights to compulsory education for thechildren of migrant workers. The paper presents the status quo of the protection of the rightstaking Tianqiao District of Jinan City for example， through the literature review， the form ofquestionnaires， individual interviews， and objectively points out the deficiency of the rightsexisted in reality.Part three: the analysis on the reasons of the deficiency of the rights to compulsoryeducation for the children of migrant workers. From the following three levels， dislocation ofthe relationship between the education law and education policy， the absence of the legalguarantee of the rights to education， weak family support capabilities， this paper puts forwardin-depth analysis of the reasons for the lack of the rights to compulsory education for thechildren of migrant workers.Part four: the suggestions on the countermeasures to guarantee the rights to compulsoryeducation for the children of migrant workers. First， to improve the education legal system， providing possibility for transition from “education policy“to "education law"; Second， tostrictly enforce the educational administration law， providing guarantee for transition of therights from "ought" to "actual"; Third， to unimpeded the relief channels of the rights，establishing two-pronged protection mechanisms including administrative relief and judicialrelief; Forth， to improve family education and social service support capability.
