| Labour dispatch, a new recruitment way, has boomed in recent years, has led to the common occurrence of labour disputes, among which massive incidents are not rare, and has drawn attentions from all walks of life, especially on the unceasing dispute of its merits and defects, keeping or abolishment. In January 2008, Law of Labour Contract was issued, in which relevant regulations on labour dispatch were included, aiming at preventing the abuse of labour dispatch and standardizing the development of labour dispatch. While during the three years since the implementation of Law of Labour Contract, the size of labour dispatch in China exploded. In accordance with the data published by All China Federation of Trade Unions in early 2011, the number of labour dispatch in China totals 60 millions, such a huge amount. The abuse of labour dispatch is majorly found in state-owned enterprise, government and institution, and in some central enterprises and even in Law of Labour Contract over 2/3 staffs are from labour dispatch, which has evolved into a social phenomenon from a special system phenomenon.A large number of dispatched labourers rather then employees are adopted by accepting units, which is actually a wrongful action taking advantage of flaws in law and running counter to the constructing of a harmonious society. In the light of the statement on relationship between Marxist productivity and production relations, if the contradiction between the labor and the capital cannot be timely solved, the development of productivity will be limited. It is an urgent affair to improve the relations between the labor and the capital.It is true labour dispatch in China should be standardized by laws, but the root of the abuse of labour dispatch nowadays is the immaturity of the management philosophy of human resource in companies.This article reviews the producing and developing of labour dispatch in China; analyzes the positive meanings and contribution of labour dispatch over Chinese society and economy; analyzes the causes of the abuse of labour dispatch in China since the implementation of the Law of Labour Contract by taking company M, a large-scale state-owned enterprise, for example; analyzes the problems of labour dispatch occurred during company operation by means of empirical study, the root of problems is discussed, solving suggestion is given, and the conclusion is for company M’s reference. The research result can also be used by other enterprises for reference to enhance the management level of labour dispatch recruitment, improve employment quality of dispatched labourer, and promote the healthy and sustainable development of human resource management of the company. |
