Tianjin which is located in the eastern developed coastal regions based on the second industry and the third industry primarily. With the development of the rapidly urban economic developed and the fast urbanization, the demand for new construction land increases day by day, so the occupational and compensational balance to the cultivated land is in severe situation. This paper is based on the brief introduce of the land use and the policy of cultivated land protecting in to our country, analyzing the reason why Tianjin is in the contradiction of the fast economic development and shortage of cultivated land resource, meanwhile, the whole city land use planning is hard to meet the demand of construction land of each districts or counties, in some of which the cultivated land resource is poor or in shortage.The paper uses cost benefit analysis method and the dominant strategy game theory to analyze the cost and benefits and motives of both occupational and compensational sides’deal. Through the analysis of the cost and benefit of both sides of the occupational and compensational balance to the cultivated land in different districts, it can clearly show the difference between the net earnings of the two sides in the occupational and compensational balance to the cultivated land in different districts. Through the comparison of the difference of the net earnings between the two sides can display the economic and social benefits of the two sides in the occupational and compensational balance to the cultivated land in different districts, and then judging the existing operation mechanism of occupational and compensational balance to the cultivated land in different districts is fair and reasonable or not; The dominant strategy analysis of the two sides can clearly show the deal motivation of them—because the occupational and compensational balance to the cultivated land in different districts fits the dominant strategy equilibrium of both sides.In order to reflect the true economic and social value of the compensational cultivated land and make sure the district or county which supplies compensational cultivated will not lose the expected benefits that brought by the right of land development, the land developing and consolidation funds should be improved and a reasonable market mechanism of occupational and compensational balance to cultivated land in different districts should be established. The market mechanism is beneficial to form the market price of the index of compensational cultivated land, and through the market supervision and third party arbitration solve the dispute in exchange, regulating the market of occupational and compensational balance to cultivated land in different districts, to improve the quality of the cultivated land and balance dynamically the quantity of the cultivated land and strengthen the cultivated land protection.
