With the deepening of economic reform and political&social change, China’s private enterprises have experienced rapid development. During the "Eleventh Five-Year" period, the private enterprises continually grow both in size and quantity. And their contribution to economic and social development has become more and more important. In2010, the17th executive meeting of China’s State Council issued the "Social Insurance Law of People’s Republic of China", which has aroused widespread concern in society as a whole. The establishment of the national social insurance law further standardizes and clears the rights and obligations of government, enterprise and individuals in their payment of social insurance. However, in actual operation, the phenomenon that some private enterprises pay less social insurance or evasion payment of social insurance of still exists. And therefore, to study the restraining factors which affect private enterprises to participate in social insurance has become of more practical significance.This study is to take YZ city, a more developed private economy city in Shandong Province, as an example, using the way of typical case study, combined with questionnaires, interviews and literature research, proceeding from private enterprises, local government and employees (i.e. rural migrant workers) these three responsibility body, to detail analysis the internal and external factors that constraint the private enterprises to fulfill their social insurance liability.The study shows that:the major internal factors that affect private enterprise to participate in social insurance are the private enterprises themselves and employees. These two are the main player of the game. The management conditions of enterprises, understanding of enterprises managers, enterprises culture and other internal factors, determine the enterprises’ ability and willness to participate in the social insurance. For rural migrant workers, due to the limitation of their low income, low education level and weak awareness of rights, results in their lack ability of bargaining with enterprises about social insurance. The implementation of social insurance benefits depends on the attitude of enterprises. The external factors that affect private enterprise to participate in social insurance are the institutional factors and government behavior. The private enterprises and local governments are the major players of this game. To a great extent, the implementation of social insurance is good or bad depends on the government’s supervision. However, the design of social insurance system, the local government’s behavioral motive of "economy first", the poor cooperation of law-enforcing department and weakness of executive force, etc. these external factors seriously impact the fulfillment of social insurance responsibilities.This thesis gives several suggestions to the existing problems:First, for enterprises, to implement the principle of proportionate and differentiated, and to establish trade unions organizations, etc. Second, for government, we should enhance the propaganda, to strengthen policy enforcement and intensify coordination among departments. Third, for society, we should respect rural migrant workers’ independent choose right. In a word, with multi comprehensive measures can help private enterprises better realize their responsibility of social insurance implement.
