The community is the cell of society, but also a microcosm of society. Along with the deepening of economic reform, China’s social structure has also undergone tremendous changes at the same time, the traditional social control gradually beginning to show its limitations. In this context, the traditional community social control-oriented model of autonomy also encountered many difficulties. From a theoretical perspective of the rule of law, authors examine the historical changes and realistic predicament of the Urban Community in China, explore the root causes of the problem, and then explore the path to improve community autonomy in China, and to some extent, observe the process of the rule of law in China through the perspective of the community.This article describes the origin of the problem and defines the related concepts of community autonomy first, and then describes the legal basis of community autonomy, including the theory of civil society, limited government, democracy, as well as autonomy theory. On this basis, this paper pointed out the significance of community autonomy for the rule of law in China. In the third section, this paper reviews the historical changes of the community autonomy since the founding of new China, and describes the realistic predicament, analyze the root causes. In part IV, based on the theory of governance, the paper puts forward the idea of improving the community autonomy, including clarifying the boundaries of government and Community, improving community autonomy mechanism, improving the participation mechanisms, and improving legal system of community autonomy Finally, the article presents the core argument in the concluding section.
