| Genetically modified technology has been highly disputed since its birth. When the possible impact of genetically modified technology still can not be fully judged by science, genetically modified food ((hereinafter referred to as GM Food)has been into consumers’daily lives through commercial operation. The scale of GM Food market has been rapidly developing since1994when the genetically modified tomato was grown commercially. From1980s, China has been concerned about the research of biotechnology, and has achieved remarkable achievements. Since the GM Food has both huge benefits and potential risks, legal regulations are urgently needed. China’s legislation on GM Food began comparatively late, and it’s not mature.It’s not conductive to regulate GM Food producers’ behavior, but also not conducive to protect consumer’s rights.This paper starts with the basic problems of GM Food. By summing up the relevant system of GM Food in China, this paper points out the existing problems of our current system on GM Food, and then make some suggestions to improve current legal system on GM Food safety according to foreign legislative experience.The paper is divided into three parts:The first part defines the concept of GM Food and GM Food safety, then points out the safety issues that caused by GM Food. Then analyzes the relationship between safety,risk and responsibility to clarify the nature of legal regulation of GM Food. The second part analyzes the current situation of the safety regulation of GM Foods by sorts out the relevant documents of GM Food in China.The thrid part analyzes the existing problems of our current system on GM Food according to China’s actual situation.According to the drawbacks of current system, the fourth part makes suggestions in the following areas:legislating specialized GM Food safety law; improving management system, GM Food safety evaluation system and labeling system; practicing the non-gm identity authentication;establishing GM Food security fund system. |
