In recent years, as China’s national strength has been enhanced, the social consciousness of citizens is gradually strengthened.because of the frequent cultural exchange, social sports activities and natural disasters, voluntary service in China develops rapidly. Therefore, the amount of volunteers, including registered and non-registered ones, has increased. Although they have made great contributions to the society, they have also brought some accompanying problems, such as the legal issues of non-registered volunteers, which has become a hot topic in society. Non-registered volunteer, which is only a conventionalized concept, doesn’t have a clear legal definition. The lack of specific organization, rules, regulations and laws for non-registered volunteers leads to the inadequacy of legal protection in the process of developing and implementing voluntary service. At the same time, non-registered volunteers can not get the corresponding social assistance, either, which is detrimental for the development of volunteer services in China and the establishment of democratic international image. In order to guarantee the social assistance for non-registered volunteers, the scholars have raised heated discussions and put forward many practical suggestions and solutions. Based on the results of previous research, this article aims to explore and find suggestions for the non-registered volunteer system form the law level. By conducting studies from the following aspects:Part I is the basic theory of legal system of social assistance for Non-registered volunteer. It mainly discuss the background, purpose and meaning of the research. It clarify the concept of "non registered volunteers" was and reviewed and formulated, and the object of this study was explained in order to get the whole understanding of the non registered volunteers.Part II is the defects of the legal system of social assistance for non-registered volunteers. First of all, in the aspect of society, non-registered volunteers can not get social assistance to protect their personal rights and interests; non-registered organizations can not get guarantee during their operations; non-registered volunteers can not be accepted by approved by the society; the institutionalization for the non-registered volunteers is low. Second, in the aspect of law, there are plights of establishing the relevant legal system, the condition of implementing relevant system is not yet mature, and the law implementation can not get social assistance. Finally, the reasons that the non-registered volunteers lack legal system of social assistance were pointed out.Part III is the drawing lessons from foreign countries and areas about building social assistance legal system, this paper analyzed possible paths to build legal system of social assistance for non-registered volunteers. At present, as non-registered volunteers do not have legal system to guarantee the social assistance, it is necessary to protect the non-registered volunteers, who are positive social forces. By clarifying the strategies to guarantee the social assistance for non-registered volunteer in other countries and regions social assistance solution, this paper put forward feasible suggestions on legal system construction for non-registered volunteers in China.Part IV is the coming up with advices and proposals for the legal system construction for non-registered volunteers in China. This paper proposed to manage and guide non registered and registered volunteers together, and improve the systems and accesses of registration for non-registered volunteers. At the same time, it is important to guarantee the funds raising for non-registered volunteers, and, at the same time, provide timely and proper psychological assistance. All the above proposes could guarantee the social assistance for non-registered volunteers not only in the aspect of legal system, but also in practice. All in all, by raising up the above illustrations and suggestions, this article seeks to contribute to the establishment of social assistance for non-registered volunteers, and make the volunteering service flourish in China.
