The right to educational conditions refers to the right of theeducated enjoying educational conditions and equally using theseconditions in the education process, and that the educated istreated fairly in the educational and teaching activities. As theintermediate link of realization of the right to education, that how toachieve educational conditions directly influences the quality ofcompulsory education.The research investigate the children’s right to educationalconditions in urban and rural schools from teaching hardwarefacilities (including school construction, school buildings andschool equipments) and teaching software facilities (humanresources, school management, teaching media) in schools inShanXi Province. The research shows that, in general, realization ofthe children’s right to educational conditions in urban areas isbetter than that in rural areas. From two dimensions of the right toeducational conditions, the difference of teaching hardwarefacilities between urban shools and rural schools is small, while thedifference of teaching software facilities between both schools is large, and the urban schools are significantly better than the ruralschools. Specifically, school construction and school buildings inurban schools are better than that in rural schools, but thedifference is not significant. The school equipments, humanresource and teaching media in urban schools are better than thatin rural schools.The differences between urban schools and rural schools arecaused by such reasons:(1)"the different development modelsbetween urban and rural "led to the unbalanced developmentof urban and rural schools;(2) the government focused onimproving teaching hardware facilities, and the upgrading ofteaching software facilities is still in the primary stage;(3) lackingof high quality education resources, and unfair distribution ofeducation resources in urban and rural, is an important reason tohinder the realization of children’s right to educationalconditions;(4) the teachers’ low treatment in rural primary andsecondary schools, and loss of excellent teachers, led todisequilibrium of teachers between urban schools and rural schools;(5) teachers’ level in rural primary and secondary schools is low,and the concept of education falls behind;(6) the examination-oriented education value is still playing a role in rural schools.Based on the present sitution and the analysis, the author thinksthat the gap between urban schools and rural schools can bebridged throngh increasing the education funding and teachers’salary, reforming the education management system, andcontrolling the phenomena of large classes.
