Heterogeneity of industrial technology characteristics impacts the effect ofintellectual property protection on technology innovation. By adding technologyintensity variable and technology gap variable which reflect the industrial technologycharacteristics, this paper extended the technology innovation and growth model in aNorth-South framework to the industry level and discussed the mechanism ofindustrial technology characteristics’ influence on innovation of intellectual propertyprotection. The results showed that: compared to the high technology-intensiveindustries, low technology-intensive industries are not sensitive to the intellectualproperty protection and the innovation incentive effect of strengthening intellectualproperty protection to these industries is very limited, but as technology intensityincreased, the incentive effect will gradually highlight; on the impact of technologygap on innovation of intellectual property protection, only when the technology gapbetween domestic and foreign enterprises is small and independent innovationbecomes the dominant mode of technological progress, reinforcing the protection ofintellectual property rights will be conducive to technology innovation. Moreover, thesmaller the gap is, the greater the contribution of intellectual property protection onindustrial technology innovation. Empirical test by using the data of China’s19subdivided industries of the high and new technology industry from1995to2011alsosupports these conclusions.In view of the fact that intellectual property protection system following the rule of“one size fits all” can’t drive the high and new technology industry advance by leapsand bounds entirely, the protection of intellectual property in the future must extendfrom the national level to the industry level gradually. This paper divided the19highand new technology industries into four groups based on their technology intensityand technology gap. Considering the theoretical and empirical results synthetically,we proposed the following policy recommendations in the four cases to improve theintellectual property protection:(1) for the industries which are hightechnology-intensive and have small technology gap, we should make efforts to implement the existing intellectual property protection system and explore toestablish a specialized intellectual property protection system on industry levelaccording to the protection needs;(2) for the industries which are hightechnology-intensive and have big technology gap, we should actively seek the gapsof intellectual property laws and international intellectual property protection rules onthe basis of understanding them in-depth and make good use of all the "escapeclause" to create enough time and space for the enterprises to imitate and makeprogress;(3) for the industries which are low technology-intensive and have smalltechnology gap, the relevant departments should maximize the innovation incentiveseffect of intellectual property protection through improving the related intellectualproperty protection policies under a unified constraints of laws and regulations;(4)for the industries which are low technology-intensive and have big technology gap,the use of industrial technology policies to guide the resources into R&D field will bemore helpful to the technology innovation of the industry.
