Study On The Legislation Of China National Defense Health Mobilization

Abstract:National Defense Health Mobilization is a comprehensive activity conducted by a country or a political group to implement war or tackle with other crises and organize or mobilize health resources, which is a significant part of national economic mobilization and meantime forms a relevant independent and special field in it. Consolidating and improving the peacetime and legal construction of National Defense Health Mobilization plays an important role in strengthening the normalization of the armed forces and serving the development of social economy.Current National Defense Health Mobilization put more emphasis on the construction of laws and regulations of health mobilization in emergency from the national level. However, it ignores the formulation and perfection of laws and regulations of medical service protection during warfare military action. Currently, it is customary to solve the new situation and new problems in real health mobilization with traditional thinking pattern and it is widely accepted to promote mobilization through administrative order. The normalization of military health mobilization still lacks legal ground, which attributes great importance to the lawmaking of national health mobilization, strengthening the construction of national defense health mobilization in accordance with the law, accelerating the construction of socialism country under the rule of law and ameliorating the legal system with Chinese socialism characteristics. At the same time, it provides legislative authority for daily preparation of sanitation mobilization and implementation during wars. It enhance the national capability of piecetime and wartime transformation and standard the responsibility, right and obligation of governments, citizens and organizations in sanitation mobilization for national defense. It is also the solution for legislation of sanitation mobilization.Especially in recent years, the successful experience of quick mobilization in western countries like United States highlights the defect in organization and implement of our health mobilization, which accelerates the demand for legislation of national health mobilization.This paper analyzes such issues as the existing laws and regulations and institution-building in the current implement of national defense health mobilization by means of system analysis approach, investigative approach, comparative approach and literature research approach and hereby proves the necessity of legislation in this field from the perspective of mission accomplishment and service development by military medical service. The feasibility study is based on the analysis on authority, foundation, theory of legislation and propositions and suggestions on the national sanitation mobilization legislation. Finally, it describes the legislation propositions and suggestions concerning the situation of our country in the aspect of legislation principle, which offers a conference for legislation implementation and content of national sanitation mobilization.This paper argues that it is insufficient to depend entirely on administrative order to carry out the wartime and emergency health mobilization. Therefore, it is necessary to elevate the basic principles and request of health mobilization to the will of the state, regulate the responsibilities and obligations of all the departments (industries), organizations and individuals, adjust the relationship between the state, local, and personal interests by means of laws, enhance the efficiency of health mobilization and consequently conduct national defense health mobilization in accordance with the law.
