Since the9.11incident in2001, terrorism has become a global issue that threats world peace and security. With the growing dangers caused by terrorism, countries around the world are strengthening their anti-terrorism legislation so as to provide fundamentals of laws for anti-terrorism activities. U.S. is the representative of developed countries, while India is a great power of the3rd world. Though different rights and interests of international politics exist in the U.S. and India, both of the two countries are facing serious terrorism threats. This paper compares the differences and similarities of anti-terrorism legislation between the U.S. and India from the aspects of politics, economy, culture and diplomacy. It compares the different political tradition, system and practice between the U.S. and India; it analyzes the different economic strength and the distribution pattern; it discusses the differences between eastern and western culture, between caste system remainder and citizen freedom and equality, between race&religion identification and national identification; it contrasts the regional hegemony strategy pursued by India with the global hegemony strategy pursued by the U.S. and the different influences caused by their different strategies on anti-terrorism legislation of the two countries. This paper explains the reasons why anti-terrorism legislation differences exist in the two countries through contrasting their respective legislative environment in order to research the different legislative effects caused by different national conditions. The development of anti-terrorism legislation shows the typical feature of epochal character, it is the product of a country’s national conditions, and it follows the legislative principle of continuity, timeliness, and stability being combined together. Certainly, anti-terrorism legislation should adjust in time accordingly with the changing situations of terrorism.This paper tries to provide reference to Chinese anti-terrorism legislation through learning the experience and lessons from the U.S. and India.
