On Procedural Justice In China’s Policy-making Process

Public policy is the allocation of social value carried out by the authority toachieve specific objectives.It is one of the most important achievements of modernsocial and political life, and is also an important way to achieve political democracy,economic development and social progress. Since the1950s, public policy science hasa broad and far-reaching impact around the world because of its’ strong vitality inpractice to obtain rapid development. Our research scholars who research public policybegan in the1980s,along with the deepening of the study, research on public policyand public policy science has achieved unprecedented development.China is currently in the critical period of social transformation, various socialcontradictions and complexity of the issues presented, sharp and a comprehensivefeature, which makes policy objectives have to be more diversified and integrated. Howto meet the various interests and ensure the smooth implementation of the policy, hasbecoming an important issue in today’s science. From the perspective of proceduraljustice theory of law, this thesis tries to re-examine the public policy process problemsnot only conducive to dig deep reasons of public policy deviation, and provide a validpath for the democratization and legalization of public policy.I believe that to solve the problem of public policy making process,mainly twoaspects should be paid attention to: First,the decision-making information gatheringapproach,second,the specific process of policy-making to ensure the effective use ofinformation for decision making. Studies have shown that China’s current policies ofprocedural issues include: the presence of the drawbacks of information gathering, theimperfect policy hearing system,and the confirmation of policy issues and thelegalization of policy planning are flawed. The reason is mainly because of therestricted access to the high cost of incomplete information, decision-making systemand decision-making factors participants themselves, the public and governmentcommunication difficulties and the lack of effective oversight and accountability mechanisms. We can improve the fairness of the information collection methods,improve policies hearing system, establish and improve mechanisms for publicexpression and to establish an effective monitoring and accountability mechanisms,such as measures to improve procedural justice public policy, in order to safeguard thepublic interest, to achieve public policy develop scientific programs, democratizationand legalization.
