The Study Of The Change About The Leadership System Of China’ Procuratorial Organ Before The Cultural Revolution

The Communist Party of China won the victory of the New DemocraticRevolution,is inseparable from ideological guidance of Marxism-Leninism.After thefounding of the People’s Republic of China, the Chinese Communist Party is still lack ofsome experience in national system construction. Therefore, the establishment anddevelopment of New China’s procuratorial system experienced a tortuous course,especially the leadership system of procuratorial organ which act as an important contentof procuratorial system.Therefore, as a socialist country with the Soviet Union to becomeChina’s procuratorial system construction blueprint, and legal supervision of Lenin’sthought leadership theory and vertical prosecution was to establish a new leadershipstructure in China to provide a theoretical basis. Before the Cultural Revolution, Chineseprosecutors leadership structure changes frequently, I think it can be divided into threestages: the initial stage, the stage repeatedly, tortuous stage interruption.1949to1954forthe start-up phase of the leadership of the prosecution system, experienced a verticalleadership structure and dual leadership system.1954to1957led to repeated prosecutionphase system, by the dual leadership system becomes vertical leadership structure of thefounding of New China. During the Cultural Revolution in1957to the prosecution stagefor winding the leadership system, prosecutors leadership structure was severelydamaged, the de facto dual leadership replaced the vertical leadership, but overall, in arather chaotic state, until after the Cultural Revolution, the prosecution was completelysmashed, the Supreme People’s Procuratorate has been revoked.After sorting out the establishment and development of the China’ leadership systemof procuratorial organ before the Cultural Revolution, the paper analyzed the influencefactors of the leadership system of procuratorial organ changes frequently during thisperiod.It included the concept factors and the reality factors.China’s traditional legalconcept,the law’s awareness of the Chinese Communist Party, the changes of theadministrative system,The influence of political movement to the national basic systemand the effect of implementation of the leadership system of procuratorial organ, they allhad a deep influence on the change of the China’ leadership system of procuratorialorgan before the Cultural Revolution.After analysing the factors which caused the changeof the China’ leadership system of procuratorial organ,concluded the new characteristicsof the China’ leadership system of procuratorial organ during this period,the merits and demerits of the dual leadership system and vertical leadership system and the relationshipbetween the governing party and the leadership system of procuratorial organ. Analysingthe advantages and disadvantages of different leadership system of the procuratorialorgans correctly has a great practical significance to today’s reform of the judicial system,so does the influence of the leadership of the party to the leadership system ofprocuratorial organ.
