The Reserch On Legal Issues Of Residential Self-governance Organizations

Residential self-governance organizations are the agents of residential self-governance rights, which can accept residents’delegations and represent and protect the residents’interests in public affairs of residential areas. From the "principal-agent" perspective, there are many problems in the current community of residential self-governance. And it can be embodied in indefinite relationships of "principal-agent", which can be result in indefinite legal status of some residential self-governance organizations. And there are some dual agents、 ineffective agents, and so on. This paper takes the example of Tianping Community, Xuhui District. It gives an interview to the community through nearly60%of the neighborhood by actual work.And it makes detailed analyses on the four typical residents organizations of neighborhood, house-owner committee, alley management committee the industry committee, residents cultural and sports teams, which existing legal issues in the development. And we Put forward opinions and suggestions to these problems from the perfect "principal-agent" relationship point of view.In accordance with the relevant laws and regulations, this paper analyzes the legal relationships between neighborhood and other residential self-governance organizations according to these different agents permission of typical residential self-governance organizations. And we should attach importance to the dominant role of neighborhood which is the meaning of constitution. This will promote the healthy development of residential self-governance organizations together.
