On The Legal Institutions Of Chinese Community Residents Autonomy

Studying Residents Autonomy and Community Building, the most important is combination of theory and practice, including scanning grass-roots work by specialized knowledge and trying to make the study down-to-earth. Based on this idea, author studies the development of communities in one prefecture-level city in Henan province. In approach of history and comparing with overseas experience, he wants to find the points of the problems, and then, to find some approaches and manners, which could perfect Residents Autonomy and Community Building.In chapter one” Investigation and survey on communities in Xinxiang, Henan province”, in a structure of “community-district-city”, firstly, author communicates with community operators who work on active duty, to learn on manners of working in communities, the trend of serious administration in community residents committee, holding a conference, view collection in residents, using the way of talking, asking questions, etc. Thereby, he glances at conditions of services and administration, mobilization and decision-making capacity at a base level, in communities. Secondly, communicating with officers in district-level government, in the level of system and operation in government, he learns on the relationship between communities and government, government agency, community position to find out government impacts on communities and forecast government institutions for coordination with communities. Thirdly, he learns on resource allocation to communities and their working manners when they cooperate with government municipally, investigating in community administrative department.In chapter two” Residents self-governance system in different times”, based on the content above, author put data and information in the longitudinal dimension of our countries history to study in sociology of law. He lists impacts on Residents Autonomy in early days of new China, which, the environment of Residents Autonomy was liberal and in order; the Unit Time, which, organizations and residents of personal autonomy were almost dispelled; and the trend of community idea, which is an established fact, in order to scan the development of it.In chapter three” Community law in UK and the United States”, in a horizontal dimension, comparing with laws of the UK and the United States, author tries to find out points of their experience, which are enlightening, such as rules of community remit money, Third-party involvement, guiding community by universities’ intelligence, which we could introduce them in the future.At last, summarizing collecting information, history and overseas experience, author offers proposals about Residents Autonomy and Community Building. For the lagging condition in legislative activity of community, we should think about the complexity, detailing, timeliness and openness of community development to make an overall law system, refine community administration, realize the goal of living, plan community remit money in a clear way, build long-term mechanism of community meeting, use technology to collect the will of residents, expand range of community activities, realize communication and cooperation between community and higher learning institution, which could reduce negative factor dual structure in relationship of community and administration, promote the favorable factors, utilize the available resources to make community developing in long term planning.
