Research On Protection Of Water Conservancy Migrants’ Rights And Interests

Danjiangkou Reservoir is the original source of South-North Water Diversion Project. Its need for storage leads to 345,000 people’s displacement. Therefore, how to ensure the rights of land-exploited migrants is a paramount business in this project. However, the fact is that their rights and interests are not effectively guaranteed in the process of migration, the state and society also did not shown concern for it. So the author conducted a survey about this, analyzed the actual circumstance of water conservancy project migrants’ right of property, right to know the truth, right to participate in the public affairs, and right to social security and put forward corresponding advice and suggestions according to the existing problems and actual situation. This paper is made up four parts:Part 1 mainly discusses the basic problems of the protection of rights and interests of water conservancy project migrants in Danjiangkou Reservoir. The author first give the definition of migration, the rights and interests of migrants, and the protection of their rights and interests and then analyzes the characteristics of migrants’ rights and interests. Exist stipulations of the protection of water conservancy project migrants’ rights and interests and their shortages are presented. So the conclusion is arrived at that the legislation of the protection of water conservancy project migrants’ rights and interests should be improved.Part 2 talks about the components of the protection of water conservancy project migrants’ rights and interestson the basis of constitution, including right of property, right to know the truth, right to participate in the public affairs, and right to social security.And this lays a theoretical foundation for the advice and suggestions for the protection of water conservancy project migrants’ rights and interests proposed in the end.Part 3 focuses on practice. The author had investigated two new settlements in Sheqi county from such aspects as right of property, right to know the truth, right to participate in the public affairs, and right to social security and comprehensively analyzed the circumstance of the protection of migrants’ rights and interests. The existing problems derived from this survey include a dearth of information about later settlement, insufficiency of migrants’ participation and unsoundness of social security system.Part 4, based on the results of investigation, comes up with solutions and suggestions about the protection of water conservancy project migrants’ rights and interests, including strengthen water conservancy migrants’ power of safeguarding their legal rights, the construction and refinement of legal system of the protection of water conservancy project migrants’ rights and interests and the establishment of the protection mechanism of rights and interests of migrants. These measures, to some extent, would be useful in protecting the rights and interests of water conservancy project migrants.
