Premier Li Keqiang announced that the transformation of government functions is the first task for the newly-elected State Council, and the government must to curb the power of bureaucrats, rein in government spending. Enhancing administration at the macro level, government departments should let go of micro administrative matters and let the market or society decide. Customs should also actively promote the transformation of government functions.The customs is set up for the service of foreign trade and foreign exchange, along with the reform and opening of our country, and foreign economic cooperation development, the broker industry is also appeared. The management rule of the broker industry after a long-term development formed a relatively standardized system; promote the development of the broker industry, speed up the development of foreign trade and economic cooperation. However, in the development of the broker industry improvement, the social environment changing circumstances, the problems arise, these issues include the declaration without license, personnel quality and professional level is not high. These problems leading to the unreasonable allocation of resources, customs clearance speed is limited and rent seeking. These problems and harm is closely related to the "government failure".In this paper, through interview and questionnaire survey the customs agents and enterprise and online literature data analysis, summed up the current broker industry and harms of existing management, and analysis of the reasons for the problems, to find the management reform. The reform must prevent the government failure, and to curb the market failure. The reform should enhance the market mechanism to play the basic role, strengthen the government’s supervision and regulation function, to seek cooperation in governance and social forces, promote ability of customs employees and enterprises, so as to promote trade facilitation and security, reduce transaction costs, improve the purpose of public interests.
