The Construction Of The System Of Laws Of Land Lost Farmers

As a special group which emerges in the process of Urbanization and industrialization, Land-lost farmer is either be rejected by both country and city or be marinated. Land-lost farmer is obviously at a disadvantage in the employment, children’s education, old-age security, in need of the support of government, support of policy and special protection of law. With the rapid development of China’s economy and urbanization, the number of land-lost farmers increases sharply by more than5million every year. Moreover, the family pension function was severely weakened under the attacks of the culture in Western countries, the problem of farmers’ pension finally comes out, causing the concern of the public. Take these factors into account, to establish and perfect the society insurance legal system the land-lost farm ers’ society insurance legal system in order to solve the land-lost farmers’ old-age security problem is too important to our country. We need it to alleviate the social contradiction and construct a more harmonious society, and to perfect Chinese characteristic socialist security legal system. In this article we have four parts to deeply discuss this problem.The first part chiefly introduces the background of why Chinese land-lost farmers’ society insurance system emerges:With the high-speed industrialization and urbanization in China, causing a large number of farmers lost their lands. Their ways of production was forced to change. In this process, some of the landless peasants living poorer due to various reasons. It makes us reconsider our former ways to compensate for land lost farmers. Situation forces us to complete the existed former society insurance system. At the end of this article we analyzes the necessity of building a social endowment insurance legal system in introducing a series of theories, such as Maslow’s hierarchy of needs, the theory of fair and Market Failure Theory and so on.The second part introduces how the existed system of endowment social insurance practice of land-lost farmers runs. We have tried many solutions.however the results is not so acceptable. When we made some progress, more problems occurred. In author’s opinion, the cause of this situation lies in the financial basis of china:We are too poor to build this system. The economic gap between east and west make things worse. In this paper the author will introduce all these models mentioned above in detail, and review their advantages and disadvantages.The third part describes the experiences on building the system of endowment social insurance practice of land-lost farmers of western countries such as Japan and German for readers. So that readers can form a more comprehensive impression.We can make a conclusion of this thesis in part4, solving the problems and putting forward the countermeasures. At first, show our basic principle, that is, wide coverage principle, government leading and responsibility principle, diversification principle and Scientific Concept of Development. Then design the main system. At last, give some advices to complete the relevant supporting measures, including the reform of census register system and land system reform, participation of the commercial insurance, research in reverse mortgage system which widely concerned now.
