Housing problem is a major livelihood issue related to Chinese social harmony and stability. In1984, human basic housing needs were mentioned in "Universal Declaration of Human Rights" passed by the UN General Assembly. And then it was re-mentioned in International Covenant on Economic, Social and Cultural Rights in1966."House, the foundation of the human." The housing right is expressly granted to citizens in our Constitution. In order to achieve the right, we should not only rely on the effort of the subject of rights, but it also requires the object of national rights as obligations through government action. In the process of the realization of civil rights, the "invisible hand" of the housing market has to cooperate with the "visible hand" of the government. As a starting point to develop housing security system, public rental housing system is one of the important parts to realize the right of residence of citizens. In2014, public rental housing system in our country has made considerable progress, and affordable housing and low-rent housing convergence in the implementation of the country has achieved beneficial results. However, there are still many problems in the development process which need to be improved through legislation.The author has done a lot of research on the situation of implementation of the public rental housing and consulted a large number of interrelated documents. Based on those studies on the legal system of public rental housing, this paper is divided into four main parts besides the preface and epilogue. The first part of this thesis indicates the concept and the origin of the public rental housing. The second part mainly refers to Chinese national conditions to discourse the implementing status of public rental housing and some problems emerged in the process. The third part studies the development courses and the referential experience of the public rental housing in comparison of the US, Japan, Korea and Hong Kong. In the fourth part, the author puts forward her own construction of legislation according to the existing main problems.
