China’s Legal Aid Quality Assurance Research

China begins to establish legal aid system from 1994, and legal aid has gone through a journey of more than 20 years of development. During this period, with significant growth in the case number, the quality assurance of legal aid has gradually become the focus of the government and scholars. This paper studies legal aid quality assurance in China, and discusses how to solve the problems. The purpose of this paper is to strengthen legal aid quality security work, so more and more people with legal aid needs can get the chance of eating "free meal", and make the "free meal" into "safe meal". This is of positive significance to improve the effect and quality of legal aid, and promote the rule of law and promoting justice and people-centered.This paper insists the method of combination of theoretical research and empirical research. It can be divided into four parts. First of all, in the first and second chapters, the relevant research results at home and abroad are reviewed and the combed; the concept of legal aid quality and quality assurance with putting forward my own understanding. At the same time, I apply law, management and other related subject theories to make demonstration analysis. Secondly, combined with work practice,from legal aid quality standards and subjects, the third chapter clarifies China’s influence factors of legal aid quality assurance into three aspects of law, management and supervision; then makes an empirical analysis of the legal aid quality assurance in Jinan C District. Furthermore, based on the above empirical analysis, the fourth chapter carries on in-depth discussion of problems existing in our country’s legal aid quality assurance. At last, the fifth chapter puts forward systematic suggestions to consummate the legal aid quality assurance measures with combining macroscopic and microscopic, and the point is putting forward the index system of legal aid quality standards building and quantitative assessment method by thinking and analysis.Through research and analysis:(1)Although governments at all levels make great efforts in such aspects as perfecting safeguard measures and increasing investment, at present, our country’s legal aid quality assurance still has certain problems: in the aspect of law, legal system and related regulations are imperfect, quality standards and evaluation method of legal aid is not clear; in the aspect of management, the nature of legal aid institutions is chaotic, and funds safeguard, and internal and external cohesion remains to be strengthen; in the aspect of supervision, the supervision effect of relevant departments and the recipient remains to be improved.(2) Try to improve legal aid quality assurance level through the suggestions of perfecting the legal system of legal aid and the relevant laws and regulations, clearing quality standards, unifying the nature of legal aid institutions, perfecting the funds safeguard and unit cohesion, establishing unified and independent quality supervisory organization, and introducing social supervision power.
