Research On The Problem Of Social Transformation In Prison

Social transformation in prison is a part of socialized execution, and social socialized execution is the key trend and important criminal policy of modern international execution, and also the development direction of execution in the world in future. Its purpose is to encourage successful rehabilitation of criminal, so as to prevent and reduce criminal. It forms an intimate alliance with our nation’s law spirit of prison, the spirits of building harmonious society and society synthesis governing. After more than one hundred years’ research and practice, other foreign countries have rich and mature theory of socialized penalty and experience. While our nation started this research quite late, so the social reform in prison is still at a low level, at the initial stage. As a result, researching social reform in prison has important realistic significance to improving China’s penalty execution system. Under the background of China’s judicial system reform, this thesis summarized and analyzed the related concepts of social reform in prison and the main problems facing it on the basis of expounding related theories of socialized penalty. Took F prison of Guangdong province as an example, this thesis also introduced the common practice of social reform in prison in China, and came up with solutions to solve the existing issues. This thesis has five sections.First, the preface. It mainly introduced the research’s background and significance, and also the research and practice situation of social reform in prison in China and foreign countries.Second, summary of social reform in prison--- to research the definition of social reform in prison and its gauge, and to introduce the content and characteristic of social reform in prisonThird, focused on the current situation of social reform in prison and main problems our nation is facing, including lawmaking restriction, problem of socializing prison environment, inherent malpractice of prison reform, out-of-date ideas of reform, unbalance and misplacement of reforming method, dilemma of help and education in prison, dilemma of protecting ex- convict personnel.Fourth, this section took F prison of Guangdong province as an example to introduce the common practice of social reform in prison in China under the current legal framework.Fifth, research on solutions. This section came up with solutions to improve and solve the existing issues of social reform in prison.Last, the conclusion. It pointed out that the chance for practicing social reform in prison had come, and forecasted its realization in China.
