Social Governance Research Under The View Of Legal Society Construction

In the 90s, with the governance theory’s appearance in the west, the western countries had new twist on the social development. In recent years, with the advent of globalization, China’s reformation and opening up has entered to a new stage, especially with the challenge of social transition, social contradictions and social problems gradually edgy.In this critical moment,studying the western advanced management mode and change the traditional pattern,it will has certain positive meaning about promoting the smooth transition of Chinese society.Party’s 16th, 17th and 18th were all mentioned the innovation of social management mode, it was from macroscopic to microcosmic, step by step to promote the innovation model. The third plenary session of the eighteenth further expounds the concept of social governance theory,it is more scientific and reasonable, and it emphasize sovereignty sharing, encourage the whole society to participate in national construction, at the same time it points out that the rule of law is the basic way of governing the country. However, it is not optimistic about the middle of the implementation of situation spirit,it is difficult to carry out new social governance model, not only the imperfect legal system,the power imbalance between government and citizen, but also the population of China are numerous, citizen quality is not good enough, lack of the rule of law consciousness, right consciousness, lead to the social governance and the "hardware" and "software" it need is not matching. That is to say, the innovation of social management and the construction of law society is not an isolated thing: the innovation of social management, must under the circumstances of rule of law society; And the construction of the rule of law society, are bound to the effective social management.So, this paper started from the law of society as certainly need in the social governance, come up with the rule of law society and social governance’s concepts and essential feature, analyzed the construction of the rule of law society and the close relationship between the implementation of social governance, put forward the new problems in the current Chinese society and the necessity of innovation of social management. In the background, combed the difference between reality and ideal, points out the negative effect that lack of system, law,and consciousness.Then we must strengthen the construction of pluralistic governance body of legislation power and right, especially to emphasize social soil improvement. Therefore, only to strengthen the construction of modern citizen personality can make the rule of law society construction and social governance for solid social foundation.
