Educational fairness is a problem when a commonplace talk of an old scholar, also be thenext hot issues, on the reality of what happened on the equity of education events, our citizensof equal education right and do not receive effective protection. The author writes this thesisaims to study our country education fair present situation, analyses the reasons for the statusquo, and gives his own opinions and solve the problem of some measures. In this paper, forreference at all times and in all countries and educational equality ideas continue to developachievement, to fair generation, development and contains the theory content described, forfair education meaning, intrinsic definition, basic characteristics, itself contains the meaningundertook elaborating, and based on the constitutional angle, elaborated the education fair theconstitutional basis and in constitutional law and related study, the education equity fromtheory to reality close to; through the United States, Japan, Brazil and other countries in theeducation fair present situation research, relative to the educational justice of our countrycurrent situation, draw lessons from the successful experiences of these countries, find out theequitable development of education in China a major inspiration to me; current unfaireducation present situation analysis research, reach our country the unfair education is mainlymanifested in the education unfair opportunities, the education process is fair and result ofeducation inequity, and to identify the causes of our country the main reason of unfaireducation, education irrational allocation of resources, for the vulnerable groups and specialgroups ignore, facing the new situation of the legislation and the system construction thereason such as inadequacy; for our education unfair question, This paper presents thecorresponding measures, first at the legal level, establish and perfect the laws and regulationsto promote educational equity, educational equity is the clear legal rights, a clear legalgovernment in civic education, fair responsibility, perfect safeguard special groups of equaleducation rights laws and regulations; secondly, the use of judicial guarantee fairness ineducation, through the the common law and constitutional legal relief protection of citizens’equal education rights; finally, execute the law strictly ensure fair education, the legal guarantee, so strict law enforcement is the key of realizing educational equity; in addition,beyond measure, this paper puts forward some other measures, such as the migrant workers’children education mechanism, stability efforts to develop all kinds of education, expandingthe masses of the people the opportunity to receive education and other measures.Educational fairness is a complex and specific implementation of the project, a long-termeffort, need country all aspects of coordination, but the author thinks only from law toestablish the citizens of equal education right, from the law to education equity security,education fair can have practical starting point and basis, thus the legal level EducationFairness Guarantee is the other related mechanism is the foundation, so the establishment of acomprehensive educational justice law laws and regulations is Chongzhongzhi is heavy.
