Study On Legal System Of Non-contributory Social Old Age Security In Rural Area

Rural social insurance system, rural minimum life security, rural five guarantees system and rural community endowment are the old age security systems for rural residence in China. Currently, rural social insurance system is closing to complete, it gradually merges with urban pension system. Public relief and social assistance is maximized with the development of rural minimum life security and rural five guarantees system. Building rural nursing houses is the main measure of rural community endowment. However, society reform is necessary now. We are in the face of challenges from pension itself, family and community. Consequently, there are four main issues addressed in pension system, which include unsatisfactory of rural social insurance system, high cost of social relief, chaos for development of rural community endowment and the problems of relations between different types of pension. To motivate the development of pension, non-contributory social old age security is on the top of list.The establishment of rural non-contributory old age security legal system is conducive to ensure fairness in bottom line, the realization of real social equality, so as to make farmers really enjoy the social security right. It satisfies the demands of rural residences, and it will get supports form them. The foundation of rural social insurance system can be applied to the non-contributory social old age security. Meanwhile, government and regulator have the ability to pay the cost of running non -contributory social old age security, which make the system feasible.Standard class and means test class can be the two main classes of non-contributory social old age security. It is considered as a way to reduces poverty, but also a way to pay benefits to the whole society. According to the research of pension system in U.S and Canada, the number of poverty reduces significantly. In Finland, government develop the system with respect to the development of society in order to maximize feasibility.Considering the different background of China, non-contributory social old age security should guarantee the basic insurance. It must be adjusted with respect to the development of economy to make sure that the non-contributory social old age security and economy play in a same level. Government should make regulations to guarantee standard class pension for every rural residence and means test class pension for proved rural residence. Meanwhile, government must develop the contributory social old age security. It promotes the completion of social old age security.
