The teachers of migrant workers’ children school are the decisive factor of the quality of migrant workers’ education, it also play an important part in satisfying the demand of the mobile children. However, all sectors currently lack the attention to this group. The teacher of migrant workers’ children school is forgotten by the human and their survival and development condition are grim. The deficiency of teachers’legal rights of the private migrant workers’ children school will directly affect their working enthusiasm and commitment, it will also indirectly affect the quality of education received by floating children who are already belonging to the vulnerable group. Consequently, the teachers of migrant workers’ children school are the group who are urgently need concern and love and they are world that not allow to ignore as well.The research methods of this study are literature analysis and survey methods, and survey method includes questionnaire an interview. Though investing some teachers of migrant workers’ children school by questionnaire and individual interview, we can comprehensively, systemically analysis the present situation of the teachers’ right protection and explore the factors leading to the right and interest loss, and then seek the ways to protect teachers’ right.This paper is divided into five chapters:1. The first chapter mainly elaborate the research background and the key concepts will be defined in the article;2. The second chapter divided the process of the emergency and development into three stages so as to understand the macro-background of the present situation of the teachers’ right protection;3.The third chapter focus on the present situation of the teachers’ right protection, according to the findings, the right to sign labor contract, to have rest and holidays,to enjoy the social insurance,which are basic right of the teachers of migrant workers’ children school, are infringed by different level, meanwhile, their right to be paid, to be paid leave during the winter and summer holiday, to participate in democratic management,to attend the in-job training,are not totally put in to practice.4. The fourth chapter primarily analyze the cause of the right and interest loss of the teachers of migrant workers’children school, which is based on the based on the theory of new institutional economics. This thesis focuses on research in the aspect of informal institution, formal institution and enforcement mechanism. Regarding to the informal institutional, it mainly due to misconception of government, the fault of the guiding ideology of the school and the faint legal consciousness of the teachers; in terms of formal institution, it chiefly because of the incomplete of the labor contract system, the absence of the government assistance system, the lag of the democratic management; in the aspect of the enforcement mechanism, it primarily on account of the lack of the procedural rights and the weaken penalties;5. The chapter 5 put forward corresponding solutions and measures according to the problem in the course of protecting teachers’right. We can build long-term mechanism of guarantee of teachers’rights and interests through updating the informal system, perfect the formal system and strengthen implementation mechanism.
