The Study Of The New Model Of Rural Social Pension Insurance System In The Three Northeastern Provinces

Issues related to agriculture, rural areas and rural residents refer to the "Three Rural Issues" for short, which are the three major problems that our country needs to solve urgently."Rural residents" issue mainly refers to the problems of social security for rural residents, the pension issue of rural residents is not only the top priority of the "Three Rural Issues", but it is also the stepping stone to solve the "Three Rural Issues". Whether the issue of the pension problems of rural residents can be solved well or not is related to the solution quality of the "Three Rural Issues" and it also related to the construction of the entire rural social security system and the harmony of the whole society.In2009, according to the essence of the17th Congress of the Communist Party of China Central Committee and the third plenary session of17th Communist Party of China Central Committee, our State Council formulated, promulgated and implemented the "Guiding opinions on carrying out pilots of the new rural social pension insurance" National Publication (2009) No.32. The implementation of the new rural social pension insurance system is a critically significant social pension policy promulgated by the State and the promulgation of the policy has landmark significance for the rural social pension insurance system. Although the implementation of the new policy is a big shock to the previous pension insurance system, it brings hope for the proper solution to the pension problems of rural residents. But the implementation of the new policy has not been able to really solve the pension problems in all regions. For example there are some rural social pension problems in the three northeastern provinces. As we all know, the three northeastern provinces lying in cold zone and with harsh climate conditions are big agricultural provinces and have a large amount of rural population. And rural population occupies a large proportion of each province’s total population. The social pension problems of rural residents have always been one of the major difficult issues to be solved urgently for the three northeastern provinces and it is an urgent problem for our government. The significance of the legal system of new rural social pension insurance is self-evident. This paper focuses on the actual situations of the three northeastern provinces and formulates the legal system in accordance with the local characteristics of the three northeastern provinces, in order to provide references for the national legal system of pension insurance.The main innovation of this paper is to develop legal system of new rural pension insurance in compliance with the actual situations of the three northeastern provinces, directing at the special situations of the three northeastern provinces. This paper includes several parts as follow:the first part is an overview of relevant theory of the legal system of new rural pension insurance, and discusses from three parts:the situation of rural pension insurance system; the necessity of rural pension insurance system; the theoretical basis of establishing rural pension insurance system. The second part analyzes, discusses and studies the specific circumstances of the three northeastern provinces. The third part is to elaborate, analyze, compare and reference the pension insurance system of developed countries. The fourth part is to discuss specific measures from the basic principles and feasible analysis of the construction of legal system, combining with the specific circumstances of the three northeastern provinces.
