The core research of this paper is the rights to the land in Taiwan.This paper analyzed the history of Taiwan from suffering land distribution unfair criticism, then established the equalization of land ownership successfully.The author intended to use the history of the development of Taiwan as the main axis of time,, in 1945 as the time node, which were divided into before restoration and recovery in two periods,among them, the period before the recovery was again divided into Qing Dynasty and the period of Japanese occupation. The thesis based on the analysis of Taiwan land distribution of each period,and that, on one hand,the evolution of land rights in Taiwan had abandoned the irrational elements, on the other hand,it also had inherited components.The Japanese occupation period followed the rent reform of Qing Dynasty,abolished the unreasonable rental right system of the Qing era,then established the land registration system,and the Japanese government’s implementatio-n of the land registration rules,which lay a good foundation for the smooth implementation of the recovery of the Nationalist government after the land reform.Finally, the reform of ownership of land implemented the land to the tiller successfully,removed the obstacles for the establishment of the average land ownership system, paved the way for realizing the equalization of landownership. In conclusion,in Taiwan the average land ownership system did not born, nor accomplished at one stroke, its establishment had its historical and social factors.Through this research, the author thought: from the macro view,Taiwan’s land distribution relations after the common land ownership, private ownership of land( Including the private ownership of the big landlord class before restoration and small private ownership of farmer workers after the retrocession)and the average land evolution;it appears from the microscopic angle, after the "three seven five" land,homestead, land to the tiller, the average land ownership as well as the overall average urban land, the average land ownership system had been established in Taiwan.Then the author found that,after the retrocession of Taiwan,the right to the people was a prerequisite for the rapid economic development, also the powerfulsupport for the great success of average land ownership system in Taiwan.Although,the different nature of land system between Taiwan and mainland china,from the point of improving the efficiency of land use,realizing the social fairness and justice, improving the land ownership system,the pursuit of land system on both sides of the same spirit.So the author hoped to the study could be good for a new round of land system reform.
