A Study On The Legal System Of Energy Efficiency Label

Promoting energy conservation and emissions reduction and ecological environmental protection are important tasks of "the 13 th Five-year Plan". The key to energy conservation and emissions reduction is to save energy, improve energy utilization efficiency, and reduce carbon emissions. To realize the goal of economic and social energy conservation and emission reduction, and then to achieve environmental restoration and protection through a comprehensive use of economic, legal and administrative means. It can not be a short-term social behavior which research and development on energy saving technology is promoted in production stage and popularized in practice, the concept of green energy consumption is promoted in the field of consumption, the energy-saving lifestyle is spread the whole society, but make the whole society generally accepted concept of green energy consumption through system innovation. The innovation of the modern social life is that the result of system innovation is immobilized in the form of law, thus to provide guidelines for social life, regulate the social life behavior of social subjects. The standardization of law cannot stop in energy conservation and emission reduction and it should be innovated along with the change of environmental situation, so as to protect the development of society.Problems existing in energy saving and emission reduction in the process of economic and social development are organized and the new national measures in this field are focused through the researches on the current legal system of energy efficiency label. In view of the current new problems in the field of energy conservation and emissions reduction, it is hoped that the new ways of solving problems are put forward through legal system innovation, the state laws and regulations on energy saving and emission reduction are perfected, the legal system of energy efficiency label is formed, thus to build a foundation for improving energy utilization efficiency, and realizing ecological recovery protection.This article starts from the basic theory of energy efficiency label legal issues, and focuses on the legal system support of energy efficiency label, on the basis of in-depth analysis of energy efficiency label issues. The right of knowing environmental information can guarantee every citizen's environmental rights, and also should be a basic right; the externality theory can promote the environmental protection work. The energy efficiency label system can not only fully reflect the carbon emissions, but also guide green consumption idea and promote energy conservation and emissions reduction.In 1950's and 1960's, the Capitalist development boom, environmental pollution damage incidents which has a serious consequence,happened in the main developed countries in the world, resulting in a huge waste of life property. People began to think about whether there is any problem in the way of the human development. The main developed countries began to explore a new model of development. Therefore, there are many legal systems of energy efficiency label on system innovation and gradually forming an effective legal system of energy conservation and emissions reduction with the characteristics of different countries.The target of energy conservation and emissions reduction, per GDP decreased by 17%, was proposed in the "13th Five-year Plan". Thus it is easy to infer that: the energy laws and regulations is not perfect in our country; there is a big gap with the need in reality; the system design is not reasonable; lack of a unified system of energy law. According to these problems, the energy efficiency label system in China is improved and the related legal system is constructed based on the successful experience of western developed countries for reference. The third party evaluation mechanism is introduced to optimize citizen participation. The energy saving fund incentive system is improved and the scope of carbon trading system is expanded to promote the perfection of legal system of our country energy efficiency label and finally provide legal system safeguard for economic and social development and ecological environment recovery protection.
