The Study Of Variant-form Legal Term Standardization

With the development of the national "four comprehensive" strategic layout,the rule of law has been paid more and more attention.In this context,it is particularly important to promote the standardization of legal language.Legal term is the core of legal language,the importance and urgency of its standardization work is self-evident.The standardization of variant-form legal term is an important content of legal terminology,In this paper,we will do some research aiming at some problems of variant-form legal term,and on the basis of the "term value" theory,creatively put forward a new thinking and method to solve the standardization problem of variant-form legal term,we hope to be able to put down the standardization work of variant-form legal term to the ground,at the same time,contribute our weak strength to promote the rule of law.This paper is divided into seven chapters,the specific contents of each chapter are as follows:The first part is the introduction.It mainly includes seven parts: the research object,the research background,the research summary,the research goal and the significance,the research material selection,the research mentality and the research method.The first chapter is the introduction of the "term value" theory.In this paper,we put forward four term value groups,namely,the cognitive value group,the semantic value group,the pragmatic value group and the functional value group.Among them,the cognitive value group includes the general cognitive value,the specialist cognitive value,the form value,the value of easying to identify,the meme structure value;the semantic value group includes the motivation value,the semantic transparency value and antisense system value;the pragmatic value group includes the frequency value,the distribution value,the regional value,the style value and the age value;the function value group includes the reflective value,the highlight value and paraphrase meta language value.The second chapter is about the commonness research of the variant-form legal terms.From the point of view of generality,based on the theory of "term value",we analyze the characteristics of the surface and deep features of the variant-form legal terms and do some standardization research.The first is the analysis of thecharacteristics of the surface form,through the analysis of the 1000 groups of variant-form legal terms,we divide them into seven cases:the composition reverse,homophone and near sound phenomenon,abbreviations,subsection identical,individual word identical,the words completely different and comprehensive way;and then deep analysis of characteristics,combined with some special cases variant-form legal term,based on the "special semantic triangle" "meme theory " and " semantic three circles" theory,we discuss the the differences of naming,meme structure and semantic transparency of variant-form legal term;finally based on " terms value" theory and combined with specific examples we do some standardized operation about variant-form legal terms.The third chapter is the individual type research of the variant-form legal terms.We do some analysis and standardization research about variant-form legal terms which from the differences in the translation.Firstly,we analyze variant-form legal terms from the right and wrong translation difference,coexisting translation difference and regional translation,and then we do translation unification and standardization operation from the three aspects based on the“term value”theory.The fourth chapter is also the individual type research of the variant-form legal terms.First of all,we analyze the difference between the old name and the new name in the variant-form legal terms,and do some standardization operation based on the“term value”theory.Then,we analyze the difference between the official name and customary name,and also do some standardization operation based on the“term value”theory.Finally,according to the results of the standardization operation,we test that if the new name and the official name of the variant-form legal terms is more suitable than old name and customary name.The fifth chapter is about some suggestions on the standardization of the variant-form legal terms.The first is standardization process of variant-form legal terms,we believe that the standardization work of variant-form legal terms should follow the following procedures: 1.terms collection;2.sort,description and analysis;3.establish the main shape and standard;4.seek advice and publish standardization documents;5.construction term database;6.maintain dynamically and updating term database.The second is the principles of standardization of variant-form legal terms,we think thatthe standardization of variant-form legal terms should follow the following principles:common principle,motivation principle,systematic principle and the simplicity principle.Finally,we discuss some problems about the classification standardization of variant-form legal terms and the guidance to name new legal terms.The last part is conclusion.First of all,we summarize this paper,and then point out the shortcomings of this study,and finally discusses the future expansion of space.
