Research On The System Of Power Lists In China Under The Vision Of The Administrative Law

The Third Plenary Session of the 18 th Communist Party of China(CPC) Central Committee clearly puts forward the system of all levels of government department power list and opens the power operating procedure to the public according to the law.The introduction of the system of power list in China is an important measure to deepen the reform of the administrative system, and construct legal country,government and service- oriented government. What's more, it has important implications for the improvement of the modernization of governance systems and governance capacity level. The central government and local governments at all levels clear power, determine power, decentralize power, and limit power through the implementation of list of power system so as to limit the governments' power, make clear the boundary of the power of the government, reduce the power rent-seeking space and arbitrariness of right of discretion, and in exchange for market dynamics.Currently, the implementation of list of power system has made certain progress in some regions, but there still exists some problems. How to improve the power list system has become an urgent problem to be solved. This article mainly studies the power list system in the following parts. The first part, this paper discusses an overview of the listing of power system in China, mainly includes the background of the system of power list, the conception and distinction of power list, negative list and responsibility list.Then expounds the content of the list of power system; Then discusses the development course of power system of list which is divided into germination period, development period and deepening period.The second part discusses why our country should carry out the power list system, mainly elaborates the theoretical basis and the reality needs. In the third part,it clarifies the specific situation of the power list system in our country, and the maingovernment that listed the power list. The fourth part, finding out the problems that exists in the list of power through the analysis of specific situation. The fifth, putting forward some solutions to deal with the problems and thereby improve the implementation of the power list system, finally achieve the transformation of government functions.
