In the era of knowledge economy, the pattern of global economic integration has entered China market open to the international stage. The enterprises of China are facing more intense international competition, should continue to enhance their own strength and management level and ability,in order to stabilize the heel. Performance appraisal is an important part of human resource management is related to the ability of the company to maximize its benefits, is not only a link of the autonomy in operation of the enterprises, but also easy to link legal problem. Although profit is the fundamental survival of enterprises, the purpose of the employers to maximize its capital growth. Performance appraisal is an essential tool of enterprises to improve theirs management. Because performance appraisal belongs to the regulations of the enterprise, is a part of self-management of the enterprise. So in this regard, the theory circle of our country for the research of the relationship between law and performance appraisal is less, the specific legal also did not show a comprehensive provisions of enterprise performance evaluation, and there is no effective solution to solve some special problems in the present stage.In view of the special relationship between the enterprise and the laborer, this article will from performance appraisal involves the combination of human resource management and legal problems, especially to combine with the labor law, Such as: the production of performance plans and layers of decomposition, involves the performance of their commitment to the workers, legal evidence preservation in the process of performance appraisal,evaluation of performance appraisal results the problems of justice fair and open, using the results of the performance appraises to the post and training, and discuss the problems of terminating the labor contract. In the process of writing, this paper is based on the set up the comprehensive concept of performance appraisal, pay attention to the protection of labors. Proposed in their standards, procedures, and using of its results related to the system of legal issues, put forward recommendations in regulations and in practice, in order to realize the protection of workers rights and interests, and provide some practical support to promote the harmonious and stable labor relations.Therefore, this paper will elaborate from the following four parts:The first part through the whole enterprise performance appraisal analysis to study the development status in China's enterprises, showing the main problem. With a combination of social law, these problems have not been solved thoroughly the reasons are discussed.The second part through the analysis of the development stage of the enterprise performance evaluation standards emerging issues, including target setting, communication procedures and job analysis, This article will put forward evaluations to the legal issues, and finally make the feasible suggestions.The third part focus on describing the problems in the implementation process of enterprise performance appraisal, such as the implementation is not in place, the assessment period is unreasonable, assessment feedback process imperfect. This article will put forward the legal analysis, and propose the suggestions of standard performance appraisal, and protection of rights and interests of the employee.The fourth part mainly explains the problems existing in the enterprise performance evaluation results using, such as the implement of the elimination system,unreasonable post adjustment, and the training system. This article will put forward the legal analysis of possible problems, and this part is the most problematic aspect in the practice, is also the focus of this article. Therefor, this article will present the views of relatively well according to existing laws and regulations and judicial interpretation.
