As an important carrier of law enforcement,judges directly affect the realization of social fairness and justice,and the process of promoting the rule of law in an all-round way.Therefore,how to strengthen the judge's occupational security system is the key to the success of the judicial reform.The judge's salary system,as an important part of the judge's professional guarantee system,also determines the success or failure of the judicial reform.Before the judicial reform,the salary system of judges was paid according to the standards of civil servants.The increase of salary depended on the length of service and the level of administrative position.Due to the limited number of administrative ranks,most of the judges' salary level is not directly proportional to their practicing costs,professional characteristics and social responsibilities.Therefore,compared with other professions,the professional attractiveness of judges has been greatly reduced,and many incumbent judges have chosen to resign,resulting in serious fault in the court.With the advancement of the rule of law,various kinds of cases have flooded into the courts,and the number of cases has become a normal problem faced by many courts.The impact of court brain drain on judicial work has seriously affected the process of ruling the country by law in an all-round way.How to retain judicial talents has become an important part of the Court's comprehensive deepening reform.In the "four or five reform" plan,we should strengthen the construction of the judge's occupational security system,and according to the professional characteristics of judges reform the salary system of judges,and improve the judge's salary level through the reform of judge's duty sequence and the introduction of merit pay.In the process of judges' salary determination,judges' duty level and merit pay constitute an important part of the remuneration of judges.Judges' promotion and performance salary are inseparable from the performance appraisal of judges,how to build a scientific and reasonable performance appraisal system for judges,conduct a comprehensive survey of the judicial professional level and performance of judges,and give an comprehensive investigation ande make a timely,objective and fair evaluation,so as to apply to the evaluation results to appointment and of judges,promotion of post sequence,rewards and punishments,and the cultivation of excellent judges,will stimulate the potential of the judges and promote the judges' ability to consciously enhance their judicial competence and professionalism,so as to enhance theauthority of the judiciary.Because of the particularity of the judge's profession and the justice of the judiciary,it is inseparable from the evaluation of the judges.Therefore,the evaluation of the judges can not be equal to the general civil servants.Establishing a scientific,reasonable and detailed performance appraisal system for judges is the objective need to regulate the behavior of judges.Therefore,the more fair and scientific the judge's performance is,the more obvious the positive effect it brings.The author starts from the importance of the judges' salary system,the comparison of the domestic and foreign judges' salary system and the problems of the salary system before the judicial reform,and introduces the importance of the judges' performance appraisal system to the determination of the judges' salary system.Through the empirical study of the performance appraisal system of the judges in Y county basic court,this paper expounds the appraisal principles,contents,indicators,procedures and results of the performance appraisal system of judges in our country,and points out the problems existing in the performance appraisal system of judges in our country,such as the rigidity of the appraisal procedure,the digitalization of the appraisal indicators,the lack of rationality of the appraisal parameters,and the conclusion of the appraisal.Because of the lack of fairness,inadequate subdivision of assessment indicators,limited methods of extracting assessment data,and the lack of compulsory execution of assessment results,this paper analyses the performance appraisal system of judges from various perspectives,and puts forward some own humble opinions for improving the performance appraisal system of judges.That is to say,in the laws and regulations,the evaluation mechanism of judges should be clearly defined,scientific,reasonable and detailed indicators should be set up,information technology input should be increased,external evaluation organizations should be introduced,and dynamic evaluation methods combining subjective and objective methods should be adopted to make the evaluation results of judges more operational and targeted,and the evaluation results of judges should be reacted on the behavior of motivating judges.
