Community correction as a kind of the non-confinement penalty execution,has increasingly become the world trend and trends.And applicable community correction,the minor criminal in to the underage criminal to correct and education at the same time,also can avoid the implementation of the underage criminal imprisonment and cross infection,from society and a series of significant drawbacks.Community correction system in our country is developing rapidly in recent years,in legislation and system construction have made great achievements,but due to a late start,there are many missing in many ways,especially to the attention of the minor criminal,affected the community correction for juvenile offenders for corrective effect,therefore,hope that through this article to our country juvenile criminal community correction system for some useful exploration.Based on the analysis the current situation of community correction of minor criminal,research related provinces and autonomous regions with achievements of pilot and corrective effect,discover problem of minor sinners make the community correction system in our country.Found due to the influence of traditional ideas,the limitation of objective conditions,China's current place juvenile offenders with adults in the community to correct,not the difference on juvenile delinquents and mature,can't reflect the special protection of the juvenile criminal.Focus on community correction for juvenile criminal legislation on the lack of laws and regulations,on the system building according to the characteristics of juvenile delinquents set up specialized correctional institutions and correct management personnel,in the practice of community correction for juvenile delinquents,community correction project practice less,in the process of straightening did not pay attention to the protection of the legitimate rights and interests of the minor criminal,community correction of minor criminal problems such as easy to become a mere formality.Through comparative analysis of Chinese mainland's community correction of juvenile delinquents and outside the system of community correction of juvenile delinquents,the western developed countries and Chinese Hong Kong,Chinese Macao and Taiwan regions of juvenile delinquents beneficial exploration of community correction system,and through the draw lessons from western developed countries and the area of the minor criminal all results on the construction of community correction system,to improve the system of community correction of juvenile delinquents in our country,provides the experience for reference and theoretical basis.From perfecting the legislation of community correction of juvenile delinquents,this paper set up an independent juvenile delinquents community correction mechanism,build a specialized and professional team of community correction of juvenile delinquents,initiative and transplantation for juvenile delinquents correction of diversification,individuation project and at the same time increase the introduction of the participation of social force,and to strengthen the construction of the relevant supporting system such as the direction,puts forward some Suggestions of operability,strengthen and protect the legitimate rights and interests of the minor criminal,help to return society.
