In the process of promoting the whole society to establish the consciousness of rule by law and promoting the construction of rule by law in urban and rural areas simultaneously, migrant workers have a positive effect on the convergence of the legal consciousness of the urban and rural residents. In recent years, with the increasing number of the new generation of migrant workers, the "generational differences" on legal consciousness between the new and old generations of migrant workers have been even more apparent. Whether consider it from the CCP and the Chinese government's related policies and the top-level design of the system, or from the migrant workers' differentiation of internal structure and the different psychological needs of them, it has especially academic value and practical significance that we should combine the related theory and investigation data to study the status quo, the characteristics, the causes and the changing trend of the "generational differences" on migrant workers' legal consciousness, and put forward measures to deal with it from the perspective of promoting the rule by law in urban and rural areas and promoting the social construction of rule by law.Combing the connotation and structure of "legal consciousness" with the unique emotional experience and life practice of migrant workers', relying on the combination of literature and empirical research methods, taking "legal cognition", "legal emotion" and "legal will" as a comparative perspective to study the "generational differences" on migrant workers' legal consciousness. It turned out that the evaluation of the new and old generations of migrant workers in the operation process, convincing degree and supreme authority of the law converged. The new generation of migrant workers' cognition in laws, the legal rights and obligations and the functions of laws, and their ways to acquire and apply laws, especially when to defend their rights, and their decisions in critical times when other regulations contradicted with the law or when some behaviors violated the laws, are superior to the older generations, but in using laws, some new migrant workers tended to be similarly pragmatical, utilitarian, and lack self-consciousness. The results also showed that factors from subject itself such as their "level of knowledge and culture", "social economic status", "political participation experience", and the external environmental factors such as "growing and living environment", "traditional cultures in rural areas", "construction status of rule by law" and so on, resulting in the "generational differences" on migrant workers'legal consciousness. Along with the changing of these factors, the differences of legal consciousness between the new and old generations of migrant workers will be gradually enlarged, and the differences of legal consciousness in the whole migrant workers also will be increasingly prominent.In order to cope with above changes and better to achieve "comprehensively promoting the rule by law", we must clarify the specific target of cultivation and guidance based on the "generational differences" of migrant workers'legal consciousness, and take targeted measures to strengthen the legal awareness of migrant workers, so that the migrant workers can play a better role in promoting the construction of rule by law in urban and rural areas simultaneously. We should also according to the "Four Comprehensives" strategy layout which was proposed by the Central Committee of the CPC, deepen the reforms in an all-round way, and constantly improve the external development environment, especially the operating ambient of rule by law, gradually formed a well social atmosphere of rule by law, promoting the improvement of migrant workers' legal consciousness, better to achieve "national, government and social integrated construction under the rule by law".
