According to the Chinese electronic commerce research center,in 2016,Chinese e-commerce deals reached 20.2 trillion yuan,increasing 23.6% comparing to previous year,which accounted for 14.9% of total social consumer goods and online Consumers permeability reached 64%.This means that more than half of Chinese choose online shopping,and mobile penetration rate is increasing.According to the analysis,the scale of online shopping will enlarge further and forecasted that Online transactions will reach to 7.5 trillion yuan in 2018.In the torrent of information,the way of think and consumption habits also gradually changed,and now we can choose and buy cheap and good goods at anytime and anywhere by the phone.But every coin has two sides,the generation of new things are developing with many problems in many aspects,there exists many case of violation of consumer rights and interests.Basing on the statistics,among the complaint cases,online shopping consists 43.7%in 2015,which has increased comparing to the former year.The purpose of this paper is to discuss how to protect the legitimate rights and interests of consumers,by analyzing a series of problems existing in the network shopping and to perfect the corresponding laws and regulations and industry standards,as well as to promote the healthy development of electronic commerce.The paper is divided into four chapters.The first chapter mainly analysis the particularity of the online shopping,and introduce the concept of online shopping and e-commerce.And then I will compare traditional shopping and the B2 C,C2C mode of online participation main body and the legal relationship analysis;The second chapter mainly analyzes the infringement act of consumers' rights and interests,and pay attention to the traditional shopping consumer rights and interests that are harmed in the horizontal comparison.The third chapter analyzes the current situation and existing problems of online shopping mainly from the legislative protection,administrative protection,judicial protection and social protection four aspects which provides the basis for the following;The fourth chapter is the core and also theinnovation part of the paper,which is purpose to perfect the lawsuit pattern and put forward the proposal from the legal system,strengthen the responsibility of the third party trading platform,innovation of dispute settlement mechanism,the online mode of consumers' rights and interests protection in China and puts forward the idea of constructing demonstration.
